What you should do if you want to appeal against your rovinieta fine

In order to drive legally on the national Romanian roads, all the drivers must pay a road toll called the rovinieta. Its price is established according to the vehicle category and the rovinieta validity. In case they are caught by traffic police officers or on video cameras without this rovinieta or if its validity has expired, drivers may be subject to fines.

How can you appeal a rovinieta fine?

First, you should file a complaint to the competent court appealing against the rovinieta fine. The appeal should be typed according to a specific form. After that, you must attach any supporting evidence and send your file to the Court, which will register it and set a court date. At that date, the court will give a ruling on your appeal against the rovinieta fine.

The reports stating the traffic offence for drivers driving without a rovinieta should be transmitted to them within maximum 30 days, during which period no more penalties can be applied for the same breach. The 30-day period is according to the legislation in force.
 
You can lodge an appeal against the report stating the traffic offence and penalty applying procedure within 15 days following the date of its delivery or transmission.

The complaint should be filed to the court of law having jurisdiction over the area where the offence was committed, unless the traffic offence report does not mention other jurisdiction.

Users can be subject to penalties across Romania’s national road network as well as at border checkpoints, when going out of Romania.

Starting 1st October 2010, breaches can also be detected by means of approved technical means placed throughout Romania’s national road network, being noted in the traffic offence report.

In cases mentioned at paragraph (2), the traffic offence report can be drawn up even in the absence of the offender, after identifying the offender based on data supplied by the Ministry of Administration and Interior – Driver and Vehicle Licensing Agency in case of foreign drivers. The traffic offence report is drawn up and transmitted to the offender within 30 days following the date of stating the offence, period during which no other traffic offence reports may be drawn up for breaching the provisions of art. 8 paragraph (1).
